The law states and Social Worker special rules
do NOT apply :
(1) *A individual that requests
his or her`s files for him or herself consensual permissions and the concept of the request , can if in writing apply to the
data register { Controller } of the public body , for access to the files that the Public Body hold`s on them and their Children
.
(2) *Third party references
can not be shown without the exploited permissions and consent from the third party concerned { please see exemptions further
on }
(3) *Privileged Information
as such as used in Courts Cases or Criminal investigation`s is exempt from this and can be Lawfully with healed .
(4) *Social Services can withhold
Children`s files if they ascertain that`s a Child , could be placed in a compromising position through reading of those files or that a Child is not of Age to understand that given Permission or that the Social Services
can construe that it is not in the best interest of the Parent or Parents to read their Files .
(5) *All request must be legally
fulfilled to with in 40 Day`s from the receipt of the request , hand`s on personal data can be given to you within the 40
day limit . Filer to comply is a discretionary Criminal Offence in which is deemed discretionary at the hand`s of the Data Commissioner .
(6) *There are special Rules pertaining to Social
Work were injected into the Act at the last amendment in which states the following ; this is the only incident where a Social
Worker may have an OPENION held Legally Binding / Correct and that Social Services are NOT to remove or rectify , mark or reference to material linked to a Case this is in the Wrong.
However .......
(a) *Under RL 2002 which empowers a Person as
an equal Professional Agency in Proceedings whether with in Legal Authority or else whether as Re: L 2002 defines that everyone
is entitled to a FAIR TRIAL and to be allowed to know the Case against them at the soonest instance etc: This furthers your reading
abilities to seeing every thing except confidential files , which are protected under confidentiality Laws as YOU are empowered to be in the same position as education , GARDA / Police etc. Social Services will
deny you this right , however it is wort making an effort and certainly something to present to a JUDGE if it goes Wrong {
in addition to this you are entitled to attend the professional meeting , do NOT be deterred } ...
(b) *We wish that you start your Data Protection
Request as soon as possible and to use the following in your request , always make sure that you bring with you a few pin`s
a Roller and a very large note book with you . If you have a Dictaphone , bring it too , as you may be surprised how much
information is healed about you and your Child , as this could take you a good while to digest and transcribe into working
